New tenancies

Existing tenancies

Let's not forget existing tenancies and the risk to landlords of fines for non-compliance. It's tricky for landlords to keep pace with all the changes, so we can help make existing tenancies compliant and provide general guidance on dealing with tenants. 

Our experts also advise lettings agents to ensure that they have up-to-date information on changes in the law, to enable them to manage properties and advise their landlord clients properly.

Tenancy disputes

Disputes can occur with leaseholders, freehold owners and management companies, as well as tenants themselves. We can advise on all lettings enquiries.  

Ending tenancies

Currently there are only two ways to formally end a rental agreement; by mutual consent or through the use of a Section 8 Notice.

Section 8 Notices are now the only notice upon which a landlord can terminate an assured tenancy and a Section 8 notice includes either mandatory or discretionary grounds for possession. 

It is always worth ensuring that you get good advice as to whether you are able to serve a notice, as there are up to 11 grounds for possession. We will ensure the notice is viable if going to court, and the best way to deal with the matter, to avoid any protracted litigation.

Drafting Tenancy Agreements

We are here to draft tenancy agreements to ensure landlords are legally compliant - this could be for a new or empty dwelling, or if you are buying property with sitting tenants.

The three commonly used agreements at this time, under the current legislation, are:

  • Assured tenancy agreements;
  • Service occupancy agreements;
  • License to occupy.



Existing Tenancy Agreements

The fines for a non-compliant lease agreement are very real, yet keeping up with legislation is a tricky business. 

Our experts advise letting agents to ensure that they have up-to-date information on changes in the law, to enable them to manage properties and advise their landlord clients properly.

We can also help make existing tenancies compliant for landlords, along with general guidance on dealing with tenants. 

Tenancy Disputes

Unfortunately, not all tenancy agreements are smooth sailing. 

We advise and assist both landlords and lettings agents on day-to-day matters, some of which lead to issuing notices for breach of tenancy. For example:

  • Non-payment of rent
  • Property disrepair
  • Entry being refused for legal safety checks

The legislation also covers gas safety, electrical safety, contract law and debt recovery.

Terminating a Tenancy

Section 8 Notices are now the only way in which a landlord can terminate an assured tenancy; either under mandatory or discretionary grounds for possession:

  • Mandatory grounds for possession leave the judge no discretion. Some examples being the landlord intends to live in the property again (Ground 1), or there is a mortgage repossession (Ground 2). 
  • Discretionary grounds for possession are where the landlord has to prove that is fair to end the tenancy. Given the title, it's not surprising that there are numerous types, such as rental arrears/consistently late payments (Ground 10/11), breach of tenancy (Ground 12) and causing a nuisance (Ground 14).  

Death during a Tenancy

We are able to advise where there has been a death during a tenancy, where there may be no family members, or next of kin. 

We also advise on tenants that remain in a property when somebody else passes, or whether somebody wants to set up a life tenancy for a remaining partner.
