Judicial Review

Decisions made by Public bodies can have a huge impact on you.

Public bodies do not always get it right.  Judicial review is where the Court reviews the decision making process used by the Public Body in reaching its decision.  If it finds that the process was unfair it can require the Public Body to start the decision process again this time undertaking the process fairly.

Examples of Judicial Review includes reviews of decisions made:
  • In respect of Nursing Home fees
  • Decisions at H.M.R.C. Tribunals
  • Decisions of Mental Health Tribunals
  • Decisions of Local Education Authorities
  • Decisions of Local Planning Authorities
