Terminating Employment

There are five potentially fair reasons to dismiss an employee.  These are:
  • Capability
  • Conduct
  • Redundancy
  • When continuing to work would contravene an enactments and
  • Some other substantial reason
We specialise in advising clients where it is appropriate to dismiss someone and the procedures that must be followed. In order to dismiss fairly you must:
  • Have a fair reason for the dismissal; and
  • The dismissal must follow proper procedures and be fair in all the circumstances.
