Handling Sickness Absence

People are absent from work for many reasons.  Each case involving sickness absence needs to be dealt with on an individual basis.

Disability Discrimination

It is unlawful to discriminate against a disabled person.  If you do, then there is a risk that the employee will have a claim against you.  The amount of compensation that can be awarded is unlimited.

If you consider an employee may have a disability, you are advised to contact us before taking any action which may amount to discrimination.

Health Dismissals- Long term Absence

Ill health is a potentially fair reason to dismiss an employee if it relates to the persons' ability to do their job.  If you are considering dismissing an employee because of ill health, you are advised to contact us.

Short Term Absences

Intermittent absences can amount to a fair reason to discipline and/or dismiss.  Care needs to be taken to ensure that you are acting reasonably and have complied with the relevant procedures so that you do not face an unfair dismissal claim.
