The team is lead by Bhavani Hogarty, who has over 30 years of experience and is recommended by the Legal 500.

By definition, Dispute Resolution (previously known as Civil Litigation) covers a wide range of disputes. The solicitors in the team such as Nigel Kinder have significant experience in a wide variety of disputes, ranging from commercial contract issues to contentious probate matters. Alternative Dispute Resolution (ADR)

Notwithstanding our expertise, Litigation should be the last resort of dispute resolution. There is a duty to consider ADR before proceeding to Court and our team is able to advise you on all forms of ADR and which is most appropriate for you and your business. With our experience, we are able to act on your behalf and attend these methods of ADR with you, working hard to avoid the cost of Court proceedings.

Building disputes

We can act and advise on disputes concerning faulty workmanship, defective materials, inadequate professional advice, price, and delay.

Commercial repossession and rent arrears

Our team can advise commercial Landlords and Tenants on forfeiture of lease, regaining possession of the premises and recovering rent arrears, including use of the Commercial Rent Arrears Recovery statutory procedure.

Consumer rights – faulty goods and services

Unfortunately, goods and services can occasionally fall below expectations. We can help you understand your rights, and importantly whether you can reject the goods and get a refund.

Contentious Probate

When a person dies, disputes can unfortunately arise as to the validity and terms of their Will. We are experienced in acting for Personal Representatives/Executors/Trustees; beneficiaries and disappointed Claimants. To avoid such issues cropping up in the future, please speak to our Private Client team.

Contract disputes

It is often the case that terms of a contract are not performed. We can advise you and your business of your rights in relation to standard contracts as well as less formal arrangements and the remedies available to you.

Judicial review

Decisions made by Public bodies can have a huge impact on you, but the Public bodies making the decisions may not always get it right. The process of Judicial review involves the Court reviewing the decision making process, such as the decision of a Local planning Authority. Pardoes enjoy access to specialist Counsel and can confidently pursue a Judicial review on your behalf.

Professional negligence

Sometimes a professional advisor can let you down, be it a solicitor, a surveyor or an architect, with regard to the advice given, a misunderstanding or a complete lack of understanding. We can help to pursue a negligence claim against them.

TOLATA claims

Cohabiting couples and other family members do not share the same rights in relation to property as those enjoyed by a husband and wife. However, there may be a remedy in the Trustees of Land and Appointment of Trustees Act 1996 (TOLATA) and we are able to advise you on disputes as to the ownership of the property, including when only is one party is the registered owner.
