Financial Advisers Negligence

Making a claim against a professionally negligent Financial Adviser

Financial Advisers offer financial planning services that include Investments, Pensions, Wealth and Tax Management, Mortgage and Insurance Protection.

Their clients would generally rely on them for advice, assistance and guidance through complex financial arrangements.

A Financial Adviser will normally have a fiduciary duty to their client, for example, not to have a conflict of interest, in addition to their contractual duty to exercise reasonable care and skill.

Their responsibilities include the need to assess their clients’ needs and financial background so that the products offered are affordable; what the client needs; and have no greater risk than the client is prepared to accept.

If you have suffered loss as a result of reliance on your financial advisers advice, we will help you determine exactly whether the advice given by your financial adviser falls within the standard that can be reasonably expected and whether or not your financial adviser has breached their fiduciary duty.  If your financial adviser has failed to meet these requirements we can then help you identify the loss or potential losses you have suffered.  We can then also consider how best to pursue your claim and the likely costs.

Our aim is to give you as clear a picture of how strong your claim is and how much it is worth as soon as possible and in any event before you take the decision to commence proceedings.

Financial advisers should have professional indemnity insurance for the consequences of their negligence/mistakes/breaches of duty, which means you can have a degree of confidence and if you have to bring a claim and you are successful you should be able to recover the full amount of damages and costs awarded.

If we feel you have a good prospect of success and the value of the claim is sufficient we will be prepared to consider acting for you under a Conditional Fee Agreement – sometimes known as “No win, No fee”.
