Terminating Employment

If you find yourself wanting to dismiss an employee, ensure it falls within one of the following five fair categories:

  • Capability
  • Conduct
  • Redundancy
  • When continuing to work would contravene an enactments 
  • Some other substantial reason


In order to dismiss fairly you must:

  • Have a fair reason for the dismissal; and 
  • The dismissal must follow proper procedures and be fair
    in all the circumstances.
